Who pays for Title Insurance in Florida

Identifying who typically pays for the Owner's Title Insurance premium in Florida

Customarily who pays for the Owner's Title Insurance policy premium for residential properties in Florida varies for every county. 

Out of the 67 counties, we would see 44 counties (in white) where the seller pays while 22 (in blue) were said to be buyer-paid and 1 other (Monroe) is divided on the matter. We are sharing this map as a good reference point to guide you.


In order for the above defaults to take place, the dropdown "Who pays for title insurance" needs to be enabled.  It has the following options:

Default for the State/County - The one paying for the Owner's Title Insurance would be based on the Map guide above. (For reference, these counties default to the buyer side: Escambia, Santa Rosa, Walton, Okaloosa, Franklin, Liberty, Leon, Wakulla, Gadsden, Jefferson, Taylor, Madison, Lafayette, Dixie, Suwannee, Hamilton, Columbia, Sarasota, Martin, Collier, Broward, Miami-Dade)

Buyer - The Buyer would pay for the Owner's Title Insurance

Seller - The Seller would pay for the Owner's Title Insurance

Split - Both the Buyer and Seller would pay for the Owner's Title Insurance


If you only want the defaults to take place, we can still enable this functionality, but hide the "Who pays for title insurance" dropdown.
